Matchmallow Terms of Service

Effective Date: June 9, 2026

These Terms of Service ("Terms") govern your access to and use of the Matchmallow mobile application and related services (collectively, the "Service"), provided by Matchmallow ("Matchmallow," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of These Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. These Terms form a binding agreement between you and Matchmallow.

If you are using the Service on behalf of another person, you represent that you are authorized to accept these Terms on their behalf. Because the Service is a personal dating service, however, accounts are intended to be created and used only by the individual to whom they belong.

2. Eligibility (You Must Be 18+)

The Service is strictly for adults. You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that:

• You are 18 years of age or older;
• The date of birth you provide is true and accurate;
• You have never been convicted of, or required to register as a sex offender for, a felony or indictable offense (or crime of similar severity), or any sex crime, in any jurisdiction; and
• You have the legal capacity to enter into these Terms.

We collect and verify your date of birth at registration. Use of the Service by anyone under 18 is strictly prohibited. If we learn that an account belongs to a person under 18, we will terminate it and delete the associated data.

3. Account Registration & Security

To use the Service, you must create an account using a valid email address and a password. You agree to:

• Provide accurate, current, and complete information;
• Keep your profile information up to date;
• Keep your password confidential and not share your account with anyone;
• Be solely responsible for all activity that occurs under your account; and
• Notify us immediately at matchmallowapp@gmail.com (e.g., support@matchmallow.com) if you suspect any unauthorized use of your account.

We store passwords only in hashed form (using BCrypt) and never in plain text. You may not create more than one account, create an account for anyone other than yourself, or transfer your account to another person without our consent.

4. Email Verification

Email verification is mandatory. After registration, you must verify ownership of your email address before you can use the Service. We send a verification message to the email address you provide. Until your email is verified, your access to the Service's features will be restricted. This requirement helps protect the community from bots and fraudulent or abusive accounts.

5. The Connection & Matching Model

Matchmallow is an "intentional" dating app designed to encourage thoughtful connections rather than endless swiping. To support this, the Service uses a capped connection model (the "3+3 model") that intentionally limits the number of likes and matches available to you within a given period.

Key points about matching:

• Likes and matches are limited by design. We may adjust these limits to improve the experience.
• A "match" occurs when two users mutually express interest in one another.
• Only matched users may exchange chat messages within the Service.
• We may use the self-described attributes and "deal-breaker" filters you set to influence which profiles you see, but we do not guarantee the accuracy, suitability, or availability of any profile or match.

We may modify, suspend, or discontinue any aspect of the connection or matching model at any time.

6. User Conduct & Zero-Tolerance Policy

Matchmallow has a ZERO-TOLERANCE POLICY for objectionable content and abusive behavior. There is no tolerance for objectionable, offensive, harassing, threatening, hateful, sexually exploitative, or otherwise abusive content or conduct, and no tolerance for abusive users.

To keep the community safe, the Service provides tools that let you:

• Report any user, message, or content that you find objectionable or abusive; and
• Block any user, which prevents further contact between you and that user.

We are committed to reviewing reports of objectionable content and abusive users and removing offending content and ejecting violating users within 24 hours of a report being received. Depending on the severity, we may also take additional action, including suspending or permanently banning accounts and reporting unlawful activity to the appropriate authorities.

You agree to treat other users with respect and to follow the Prohibited Uses below.

7. User Content & License

"User Content" means anything you submit to the Service, including your profile information, name, photos, bio, interests, prompt answers (Q&A), self-described attributes, and chat messages.

• You own your User Content. You retain all rights you have in the User Content you submit.
• License to us. You grant Matchmallow a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content solely for the purpose of operating, providing, securing, and improving the Service (for example, displaying your profile to other users, delivering your chat messages to your matches, and storing your photos with our storage provider). This license ends when you delete the relevant User Content or your account, except for content already shared with other users (e.g., messages they received) and for copies we are required to retain by law.
• Your responsibilities. You represent that you own or have the necessary rights to all User Content you submit and that it does not violate these Terms or any law or third-party right.
• Moderation. We may, but are not obligated to, review, screen, or remove User Content at our discretion, including to enforce these Terms.

8. Prohibited Uses

You agree that you will not:

• Use the Service if you are under 18 or otherwise ineligible;
• Post or transmit content that is unlawful, objectionable, harassing, defamatory, hateful, violent, sexually exploitative, or that depicts or promotes the abuse or endangerment of any person, including minors;
• Post nudity or sexually explicit content where prohibited, or any child sexual abuse material (which we report to authorities);
• Harass, bully, threaten, stalk, intimidate, or impersonate any person;
• Solicit money, engage in scams, "romance fraud," phishing, or any commercial or promotional activity;
• Use the Service for prostitution, trafficking, or any illegal activity;
• Provide false information, create fake or duplicate accounts, or impersonate others;
• Upload viruses or malicious code, or attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems;
• Scrape, harvest, or collect information about other users without their consent or our authorization;
• Use bots, scripts, or other automated means to access the Service;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law; or
• Use another user's information obtained through the Service outside of the Service without their consent.

Violation of this section may result in immediate suspension or termination.

9. Safety Disclaimer

Your safety is your responsibility. Please read this carefully:

• We do not conduct criminal background checks or identity verification on users, and we do not screen users in any way beyond the limited measures described in these Terms.
• We do not vouch for, and are not responsible for, the conduct, identity, intentions, or actions of any user, whether online or offline.
• You meet and interact with other users at your own risk. Use good judgment, meet in public places, tell a friend where you are going, and do not share sensitive personal or financial information.
• We are not responsible for the conduct of any user or for any harm, loss, or damage of any kind resulting from your interactions with other users.

If you ever feel unsafe or threatened, contact your local emergency services. You can also report and block users within the app.

10. No Guarantee of Matches or Results

The Service is provided to help you connect with others, but we do not guarantee that you will receive any likes, matches, messages, dates, or relationships. We make no promises regarding the number, quality, compatibility, or behavior of other users. Dating outcomes depend on many factors outside our control.

11. Termination & Account Deletion

• By you. You may stop using the Service at any time. You can delete your account directly within the app. Deleting your account erases your personal data from the Service as described in our Privacy Policy, subject to limited exceptions (such as data we must keep to comply with law, resolve disputes, or enforce our agreements, and content already shared with other users).
• By us. We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or for any other lawful reason.
• Effect of termination. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including content licenses already granted, disclaimers, limitations of liability, and indemnification) will survive.

12. Third-Party Services

The Service relies on certain third-party providers to function, including infrastructure, storage, email, and push notification providers (described in our Privacy Policy). We are not responsible for the acts, omissions, terms, or policies of third parties. Your use of third-party services (for example, the Apple App Store or Google Play) may be subject to those third parties' separate terms.

13. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, Matchmallow DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY USER IS WHO THEY CLAIM TO BE. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Matchmallow AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Matchmallow and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any law; or (d) your interactions or disputes with any other user.

16. Apple App Store — EULA Terms

If you download the app from the Apple App Store, the following additional terms apply and, in the event of a conflict with the rest of these Terms, control with respect to your use of the app on Apple devices:

• This agreement is between you and Matchmallow only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
• The license granted to you for the app is a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support for the app. Any warranty claims, product liability claims, claims that the app fails to conform to legal requirements, and claims arising under consumer protection or similar legislation are the responsibility of Matchmallow, not Apple. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
• Matchmallow, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability, legal/regulatory compliance, and intellectual property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms in the app or on our website and updating the Effective Date). Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. You agree that the courts located in the State of Israel will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of your country of residence.

19. Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
